Bankruptcy FAQ's

Let us answer your bankruptcy questions

What debts do you still owe after bankruptcy?

This may include any debts you didn't list on your bankruptcy documents, as well as domestic support obligations, student loans, tax debt, debt incurred through fraud or false pretense, criminal fines and penalties, and claims from auto accidents.

What happens with secured debts?

A secured debt is one in which the value of the property protects the lender from loss. In some cases, you can reaffirm the debt, which means you and the lender agrees to carry on the loan as long as it remains paid as required.

In cases where you cannot get the debt caught up, you may lose the secured property to the creditor. It's best to remain current on your property if you don't want to lose it in bankruptcy.

Should you reaffirm your debt?

Only you can answer this. If you can remain current on payments, reaffirmation is often acceptable. If not, it may be in your best interest to walkaway from the debt through bankruptcy.
